The loony left needs to get rid of this idea that a trial is unfair if anyone on the jury has ever heard of the case before. Enforcing this crackpot notion in the courts is how we keep ending up with juries composed of 12 of the stupidest humans that could be found.

Whatever happened to the independence of the Judiciary? Just because someone in the executive or legislative branch makes a comment on a case, it should not affect how they rule. This is a ludicrous argument. Judges should simply impose sentences based on the facts before them.

So Obama said Bergdahl was a hero for deserting his post. Then Obama trades 50 terrorists and $500 million for the deserter. Trump rightly points out that Bergdahl deserted his post. Then Bergdahl pleads GUILTY of desertion! Now you are blaming Trump for getting it right! Screw you NR!

Fair. I wish he’d temper both his commentary and tweets when they address situations which can be managed, based on the facts, by the appropriate subordinates. That said, I wished like Hell that Obama didn’t hold the Dog & Pony show with Bergdahl’s parents or prematurely opine regarding Boston Cops acting “stupid”! Yet, due to his famous(?) Beer Summit for the latter, he was awarded the Nobel Peace Prize!

It’s pretty stupid since his comment was made AFTER the guilty verdict. Therefore it didn’t threaten the court Martial’s impartiality. Isn’t sentencing up to a panel of officers here??? Like Trump is really going to influence them. They’ve already all the facts. The UCMJ dictates the sentence.

I’m guessing that maybe two people in this thread actually read the article, given the comments. It’s really simple; trump, in effect, reiterated his comments. He’s the commander in chief. That constitutes an order to the military to find the defendant guilty. That’s something he can’t do. That’s the problem.

I don’t think Trump’s comments, made before he was elected president, prejudiced the court. A military court is not a civilian jury, easily swayed but outside sources. NR is up to their usual alarmist tactics, again.

Did this surprise anyone, how would they fill if our soldiers refuse to fight because he got by with it then they should. If he get by with this then my faith in the military justice system is gone. I will never talk anyone in joining again but instead refuse. lot of use during Nam didn’t agree with the military but obeyed our orders.

Federal judges would argue that they are certainly an independent branch of the government under the Constitution. Fed Judges are appointed by Presidents; yet they are certainly not beholden to that President in their rulings. Presidents–as CinC–have every right to comment on trials of military traitors–as Bergdahl certainly is. So, if a Federal judge allows Presidential comments to interfere with his/her legal/Constitutional judgements, then the responsibility for that is entirely on that Federal Judge.

I doubt that more than a slight minority of enlisted men would be sympathetic to a fellow serviceman who deserted in a combat situation and caused death and harm to his brothers who were ordered to look for him. This article doesn’t hold water.

He confessed so the question of a fair trial is irrelevant. The judge and the judge alone will decide the punishment. Maybe justice (and Trump) would be better served by a no comment now and then but I don’t see it making any difference in this case.

This is a military court, not a civil court. The judge is perfectly capable of deciding this without regard to what Trump said. Bergdahl is a known traitor who has confessed to deserting his unit. The judge cannot allow politics to get into his way in making a decision on the punishment of Bergdahl.

We know he is a deserter and traitor – individuals were killed and injured looking for him – terrorists were released by Obama to get him back – his parents were invited to the White House by Obama – he should get the maximum sentence possible.
